The ACICA arbitration shall be conducted in Sydney, Australia (or any ACICA Centre which the Parties agree) before a single ACICA arbitrator, who shall be a retired judicial officer. The parties shall bear their own attorneys’ fees and costs of arbitration unless otherwise ordered by the arbitrator. The Parties shall split the ACICA arbitrator fees and expenses equally. The ACICA Arbitration Rules, as modified by this Agreement, shall apply and the arbitration shall be conducted in English.
